How Often do Homeowner’s Move?: According to an article in Atlanta Agent, The typical home in the U.S. changes hands every 12 years, down from 2020’s peak of 13.4 years and 12.9 years in 2021, according to a new Redfin report. People staying in their homes longer is contributing to the lack of inventory that continues to impact buyers. Eleven years ago, homeowners stayed in their home for an average of 10 years. Eighteen years ago it was six and a half years. That longer tenure is being driven by older Americans as those 65 and older having owned their home at least 23 years and those ages 35-64 owned for at least eight years, according to the report. Yet, younger homeowners are on the move. Interest Rate Updates – Homestar Financial Corporation: Thank you to Jay Alexander for sharing with us this information. After the recent Jobs report, which came in stronger than expected, and slower progress on inflation in January, the Federal Reserve is once again adopting a tough stance. James Bullard, known for his outlier views and calling for a 7% Fed Funds rate, has been advocating for a 50 basis point hike at the last meeting and is looking to repeat this at the upcoming March 22 meeting. Mester and Kashkari, who previously downplayed inflation concerns, are now joining in the call for future hikes. However, with Fed Chair Powell indicating a 25 basis point hike and the economy taking time to feel the effects of previous hikes, the Fed may have already done enough. Despite a disappointing January report, there is clear disinflation in the pipeline and shelter costs are expected to catch up soon. While recent yield jumps may seem concerning, slower jobs growth is expected in the upcoming March 10th report, and future inflation reports are anticipated to show progress, particularly once shelter costs catch up. Looking ahead, this week’s agenda includes:

2021 vs. 2022 Residential Market Statistics (GAMLS): Much like 2021, 2022 was a huge year for the Georgia real estate market! During the first half of last year, month-to-month residential sales volume remained elevated compared to 2021 numbers whereas the latter half of 2022 brought higher mortgage interest rates and thus resulted in lower monthly sales volumes across GAMLS membership for residential properties. Sales volume in 2022 was reported lowest in November 2022 at approximately $2.8 billion (~30% decrease from November 2021). This led to an overall sales volume decrease from 2021 to 2022 of 4.65%. Additionally, all 12 months of 2022 showed a decreased amount of units sold from 2021 which resulted in a 15.71% year over year decrease. Despite an overall decreased number of units sold and decreased sales volume, the median sales price of homes remained elevated throughout the entirety of last year for a year over year increase of 15.31% from 2021. Median sales price peaked across GAMLS membership in June 2022 at $375,000. The most notable change in the Georgia real estate market from 2021 to 2022, was the increased amount of active listings on the market towards the end of last year. Although still less than pre-pandemic levels, it was a significant increase from the amount of active listings on the market at the end of 2021. With the amount of active listings being the highest in October of 2022, there were nearly 23,500 active listings on the market whereas in October of 2021, there were only 13,278. Similarly to 2021, the month of June showed the highest amount of new listings for the year, soaring to 17,090. The median amount of days a listing spent on the market also slightly increased from 2021 (7 days) to 2022 (9 days).

ARA December 2022 Market Brief: The Atlanta REALTORS® Market Brief is designed to offer an overview of the Atlanta residential market by providing a synopsis of sales and home prices, and covers 11 counties: Cherokee, Clayton, Cobb, DeKalb, Douglas, Forsyth, Fulton, Gwinnett, Fayette, Paulding, and Rockdale.

Demand: December residential sales were at 3,973, a decrease of 40.2% from the previous year.
Price: Average and median sales prices continue to outpace 2021’s figures, with positive gains. The median sales price in December was $389,000, an increase of 3.5% from last December. The average sales price was $462,500, up 4.4% from the previous year.
Supply: Atlanta area housing inventory totaled 10,547 units in December, an increase of 45.9% from December 2021. New listings totaled 3,845, down 26.0% from December 2021 and down 23.3% from the previous month. The month’s supply over a 12-month period decreased to 1.9 months.
Summary by Michael Fischer – ARA President: “The Atlanta real estate market has been rebalancing over the last several months, with the number of listings increasing and the total number of sales cooling from the records set last Spring,” reports Atlanta REALTORS® Association President Michael Fischer. “Historically, housing is in short-supply, but more balanced conditions will present Buyers with opportunities they haven’t seen in several months.” “With interest rates continuing to pull back from recent peaks, we are expecting a busy spring market on the horizon as Atlanta continues to be a great place to live and work,” says Fischer.

Form of Earnest Money: Although it may be convenient for Buyers to send Earnest Money to a Holder via Venmo or CashApp or Zelle or Paypal or Bank to Bank Transfer, these electronic methods are most likely NOT in the best interest of your client and most likely NOT acceptable form of Earnest Money for a Holder. Three things to keep in mind:

Lender will need to document the Source of the Earnest Money funds & if unable to do so, may require ADDITIONAL Earnest Money from Buyer

GAR & RE Forms Contracts require that Buyer & Seller agree on the form of the form of the Earnest Money

GAR Contract (F201 – Purchase & Sale) adds the contractual provision that the Holder is not required to accept Earnest Money in a method not acceptable to the Holder (GAR F201 paragraph B6)

How did an agent (NOT MX1 Agent) Lose Buyer’s Earnest Money through DotLoop?: Thank you to Christina Adams of Hartman Law (Christina@HartmanLawFirm.com for explaining to us at the Woodstock Sales Meeting what happened in a situation where an agent lost a Buyer’s Earnest Money by relying on DotLoop to send Notice and not following up. An agent represented a Buyer who terminated a contract – or THOUGHT so – prior to the end of Due Diligence. The agent sent the T&R to the Buyer to sign through Dot Loop & got it back. Then sent the signed Notice of Termination to the Seller’s Agent – or THOUGHT so – through Dot Loop. The Buyer’s agent never followed up or let the listing agent know that the Buyer signed a T&R & the agent sent it to the listing agent. Turns out DotLoop NEVER sent the email. Agent never followed up hence Contractual Notice though SIGNED by the Buyer prior to the end of Due Diligence was never SENT to the Seller prior to the end of Due Diligence. Therefore, the Buyer defaulted on the contract and the Holder disbursed the earnest money to the Seller as liquidated damages for the Buyer’s default. The AGENT ended up paying the Buyer the Earnest Money rather than going through an E&O lawsuit. Point of Practice: Follow-Up with agents & holders of Earnest Money & Closing Attorneys & Lenders when you send or THINK you send documents!

Criminals will be eager to cash in on online shoppers. Ransomware Attack Targeting U.S. – Be vigilant when opening email messages, especially during the holiday season. What can you do to protect yourself?

Validate URLs embedded in email links 
Do not click on links in email messages you did not expect (Did you really order something from Amazon?)
Verify the sender
Double check the domain name of the sender, especially the spelling (Are you really emailing who you think you are?)

1.     Your NAID Portal account username will be changed to match your email address.
2.     Multiple NAID Portal logins with the same email address will be combined under a single login.
3.     You’ll no longer have to answer security questions to reset your password. Instead, you’ll be emailed a temporary passcode. To update your email address, log into the NAID Portal and in the upper left of the screen, go to User Info

Licensing Stats & GREC Activity At the recent Education Advisory Meeting of the Georgia Real Estate Commission in October, the Commission provided a report of the trending number of licensees.

The total number of 113,430 real estate Licenses is the largest number for the state in the Commission’s history. (86% active and 14% inactive.) This is a net increase of 4,763 Licenses in the last year.

The Commission currently issues an average of 800 new licenses per month down from 1,200 licenses per month a year ago.

In addition to processing applications, the Georgia Real Estate Commission answers approximately 6,000 calls and 1,000 emails per month.

The following is the breakdown of the 97,070 Active Licensees: • Brokers, Salespersons, CAM 88 % (20% are Brokers.) • Real Estate Firms 12%

The number of licensed Appraisers is 4,279 down from 4,236 the year before. The number of licensed Appraisers has remained steady the past few years after many years of a slow decline.

The number of investigative cases for both Real Estate and Appraisal is currently 640. The majority, 90%, of the cases concern real estate Licensees primarily because there are more real estate licenses. Of the real license investigations, about half are background application cases from individuals applying for a license.

Avoid these 6 Outdated Marketing Trends (RealTrends):    Are you sticking with tried-and-true marketing techniques? Consistency is good and if it’s working, then why change? But, there are ways to update those techniques and put a fresh spin that may give you stellar results. For example, traditionally, spring and summer were the busy seasons, and many agents concentrated their real estate marketing efforts on that April-to-September period. But as the internet has made listings more accessible to the general public, many buyers have opted to buy in less competitive periods. In fact, some of the traditionally slow periods — between Thanksgiving and New Year’s, or the post-holiday dead zone of January and February — are now targeted by savvy buyers as the best time to get a deal with little competition from other buyers. Valuable incentives such as homebuyer rebates have also pushed buyers to shop around throughout the year. Additionally, the old spring-to-summer rush was often related to families rushing to get into new homes while their children were out of school. But many younger buyers are child-free, and are open to buying any time of the year. Is LLC in good standing? – Check on GA Secretory of State (SOS) website
Check out their Articles of Organization (SOS)
Check for Operating Agreement – that would state a list of members & who has authority to sign documents to engage the LLC in business – can be created at the Closing Table
May need a Corporate Resolution to appoint a member who has authority to sign – may be created at the Closing Table
Is the CFPB in Trouble? Litigation Threatens the CFPB: The Consumer Financial Protection Bureau (CFPB) is the entity that enforces the Truth In Lending RESPA Integrated Disclosures (TRID) rules that impact your closings with Federal regulations governing our lenders & closing attorneys. On October 19, 2022, a three-judge panel for the U.S. Court of Appeals for the Fifth Circuit ruled(link is external)  that the Consumer Financial Protection Bureau’s (CFPB’s) independent funding stream from the Federal Reserve system was in violation of the Constitution’s Appropriations Clause and separation of powers principles. In Community Financial Services Association v. CFPB, the court vacated a 2017 rule regulating payday lending because the agency promulgated the rule using unconstitutionally requested funds. Read more from NAR here…

AL – Calhoun County Supra Ekey Issues:   Some members are having issues with your supra ekey. If you have an unpaid balance, due to changing credit cards or your card on file has expired, you will not be able to get an update code or pay the invoice because Supra is having billing issues. Please let me know if you have an issue, I will call Supra and they will reset your account so you can still use the key, until they have their billing issues resolved. If you have an android phone, there is issues with the phone number for Supra staying in your phone. You will need to request an authorization code. To request an authorization code you need to open the ekey app, click on more at the bottom, click on about ekey app, click on reset authorization code, a code will be sent to your email or your cell phone. May those who are observing Yom Kippur have an easy fast! – Beginning on the Evening October 4th
Changes to Facebook & Real Estate Advertising 1-30-23:   Starting on January 30, 2023, Meta will no longer support the ability for sellers to create vehicle & real estate / rentals listings using a Facebook business Page, along with the Vehicles Tab and Manage Inventory tab in markets where this feature is currently available. The free person-to-person listings for vehicle & real estate / rentals listings will still be available on Marketplace. Your ability to reach audiences via ads is also not changing. We are simply changing how inventory may be displayed in the future. 
What Will Happen After Changes are Made?   Come January 30th, 2023, you still have ways to drive success on Facebook. After this change, people on Marketplace can continue to create vehicle & real estate / rentals listings from their personal profile.
For Real Estate Businesses, people on Marketplace can continue to create real estate / rental listings from their personal profile. See the link for additional information about Facebook for Real Estate businesses.
What Can I Do About my Data?   After January 30, 2023, all existing listings that businesses have posted with their Facebook business Pages will be deleted. We recommend that you take a look at your existing listings and download them prior to January 30, 2023 if you would like. LICENSE LAW (GREC RULE 520-1-.12 Business Brokerage) Agents Involved with Listing/Selling Businesses: A real estate License is required to receive a commission on the sale of a business that includes a transfer of any type of real estate. Valuing a business is quite different than determining a listing price for a piece of real estate. Be careful that you consider the business as well as the real estate value when taking a listing on a business. The core value is based upon the projected future profits from the business itself. The listing agent should work in conjunction with the owner’s CPA and other professionals familiar with that type of business and the tax and legal implications of selling an on-going concern.  Unless otherwise excepted from licensure requirements by O.C.G.A. Section 43-40-29, a person who brokers the sale of a business must hold an appropriate license issued by the Commission if the sale of the business involves the transfer of any interest (including, but not limited to, leasehold or ownership interest) in real property. A business broker and any of the business broker’s associates who do not hold licenses issued by the Commission may not negotiate or attempt to negotiate or assist in procuring prospects for the sale of a business where: (a) that sale involves the transfer of any interest in real property, or (b) where the payment of all or part of a commission or fee to the business broker or any of the business broker’s associates in the sale of a business is contingent upon the transfer of an interest in real estate. 10 Advantages of a Market Correction:  Thank you to George Ansong for sharing with us at the Powers Ferry Sales Meeting this information.  Are there any advantages To A Market Correction?? After a couple of years of frenzied real estate market and insane appreciation of property values it seems that the real estate market is cooling down a bit. NAR data shows that inventory of homes for sale began rising in April 2022, with more than 237,000 additional homes on the market by June. This number is expected to keep rising. Sales are cooling. Earlier this month, the annual rate of new home sales fell 17% between March and April. It was also the lowest reading since April 2020. Reports show that the numbers of homes with price reductions continues to rise while the share of homes getting multiple offers is decreasing.  There is a market correction going on now – The big question is:- Are there any advantages to a market corrections ? In my opinion the answer is A BIG YES Here are 10 reasons why a market correction is advantageous.

A lot of Agents will check out emotionally, mentally and physically because of all the negative news and drop out of the market eventually – do not be one of them – Weed out incompetent and lazy agents who are not used to a market down turn ~ we fail to realize the real estate is a very cyclical business and we have to understand market cycles and what to do about them

GAR Housing Market Update – June 2022: The Monthly Housing Indicators for Georgia are in for June. Median Sales Prices were up 20 percent year-over-year, Days on the Market decreased 22 percent, and Months Supply of Inventory rose 29 percent.

Pending Sales decreased 17 percent to 12,935 ·    
Closed Sales were down 13 percent to 14,485 ·    
Inventory levels increased 24 percent to 24,673 units ·

What’s Going On with the Market in Cobb County?  Thank you to Matthew Share for sharing this insight on the MX1 Rockstars Group on Facebook – “Very interesting: I had a search set up in FMLS to notify me each week of all of the homes 500K and under in Cobb County that listed 14+ days ago and are still Active. For the longest time, this list was non existent; perhaps 2-3 properties each week. All of a sudden now, the list exceeded 500 results. What’s even more interesting: I flipped through them and noticed that at least 2/3 of them are listings with low (2-2.5%) commissions to buyers agents….just sayin’ Maybe the days of getting away with that are fast ending.”

Welcome Agents – June 2022: Please make the following agents who are your new colleagues feel welcome!
Property Surveys & Potential Seller Default: Many Title Companies will NOT issue “Good & Marketable” title at Closing without a Seller providing a Survey – EVEN if the Seller purchased the property with Owner’s Title Insurance. If an Owner got a mortgage when they purchased a property, then the LENDER is covered by the Title Insurance up to $25k (with American Land Title) and there is a $5k deductible for the Owner. The issue is many people bought a house and the Title Search did not go back a full 50 years and so a current Title Company will not insure over these previous title policies. There are some Survey Companies taking 2 – 3 months to perform a survey… yikes! Listing Agents, make sure to determine if the Seller has a survey or may need to get one. If the Title Company requires a Survey and the Seller cannot provide, this will be a Seller default on the contract if they do not close. Where’s your market video? Your community wants to know! Are you letting your clients know their opportunities? Market Update Video: https://youtu.be/0lZ3haKIMek   I get asked a lot “how is the real estate market in Atlanta Georgia right now?” Well, the market recently shifted and is normalizing! We are seeing days on market where instead of it being 2 to 3 days on the market the home will be on the market maybe 10 to 14 days. As far as inventory right we are currently averaging around 1.4 months but we’re expecting that to slightly go up because a lot of people have been priced out of the market! As far as home prices we don’t see them depreciating down and crashing but we do see a deceleration of appreciation were inside our homes increasing 10 – 25% in one years’ time maybe you’ll see 2 to 3% appreciation on the value. 2-3% appreciation is a healthy market. Will that mean that some homes won’t go under contract right away? No, there will always be homes that are very desirable and priced correctly and they’ll get immediate offers and go under contract fast. There will be some properties that are less desirable or overpriced because it’s been such a hot market and will see those properties be on the market longer and have to make corrections on their asking price. Now is a great opportunity if you’ve been trying to buy a home in the last year and have not been able to! Now could be your opportunity to get a home and not have to pay way over the asking price. Interest rates are up right now but they are expected to stay here and maybe even go up a more but then in the next year or two we should hopefully see rates come back down some and then you could do a refinance to the lower rate. Doing a refi will have a cost but, that could be a lot less expensive than people having to pay way over asking price in this recent market. My Clients looking to sell ask if they missed the time to boat? Now is still a great time to sell as it is still a “sellers market” and will continue to be with low inventory levels expected years to come. So if you just want to know what your property is worth in todays market or what are your options if you are looking for a new home. I am happy to answer any questions. ARA Market Statistics – May 2022: Atlanta REALTORS® Association (ARA), the largest association of its kind in Georgia, released its May 2022 Market Brief on residential housing statistics for 11 area counties in metropolitan Atlanta. The Market Brief, compiled by First Multiple Listing Service (FMLS), provides the only regionally-focused synopsis of monthly sales and home prices for single-family residential properties. The May 2022 Market Brief, compiled by First Multiple Listing Service (FMLS), provides a regionally focused synopsis of monthly sales and home prices for residential properties in Metro Atlanta. This summary covers 11 counties: Cherokee, Clayton, Cobb, DeKalb, Douglas, Fayette, Forsyth, Fulton, Gwinnett, Paulding, and Rockdale. Demand: May residential sales were at 6,817, a decrease of 8.3% from the previous year. Price: Average and median sales prices continue to outpace 2021’s figures, with positive gains. The median sales price in May was $430,000, an increase of 19.4% from last May. The average sales price was $518,500, up 18.0% from the previous year. Supply: Atlanta area housing inventory totaled 8,094 units in May, an increase of 9.5% from May 2021. New listings totaled 8,941, up 6.7% from May 2021 and up 9.2% from the previous month. The month’s supply over a 12-month period increased to 1.2 months.
