2018 Georgia Association of Realtors (GAR) Contract Forms – the forms required to have a Closing Attorney hold the Earnest Money. If the Buyer & Seller choose to have the Closing Attorney (rather than one of the Brokers) hold the Earnest Money, you must attach these two forms:
- F84(a) – Closing Attorney Acting as Holder of Earnest Money
- F84(b) – Agreement of Closing Attorney to Serve as Holder of Earnest Money
Watch the video to learn more about these forms. Regardless of the Holder negotiated in the contract, it is ultimately both agents’ responsibility to follow up with the remittance to and deposit of the Trust Funds by the identified Holder.
